Court Considerations
Before a parent can move away from his or her child (or move with his or her child) court approval must be acquired. First, the court will consider whether there is a legitimate reason for the move:
- Relocation for a job
- Relocation for military service
- Remarriage
The court will also consider stability, continuity, child custody and visitation, distance, age of child, relationship between parents, motives, child's wishes (for older children), and whether the move is in the child's best interests.
How Far Is Too Far?
Studies show that when a parent moves too far away from a child, it's as if they don't exist. As with any other family law matter involving children, the courts will consider the best interests of the child. While there are many issues at play in a child move-away situation, a great physical distance between a parent and a child does appear to be in the child's best interests.
